Privacy Notice

This Privacy Notice explains how Agent Finch, Inc. (“Agent Finch,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal data in connection with our website, application, and related services (collectively, the “Services”), as well as other interactions with us. Please review this Privacy Notice carefully. By using the Services, you acknowledge that you accept the practices and policies outlined herein.

1. Definitions

  • Personal Information means data about a living individual who can be identified from that data, or from that data combined with other information in our possession or likely to come into our possession.
  • Access Credentials means the information required to authenticate your identity and access our Services, including your email address and password, as well as any credentials used to connect third-party services to Agent Finch.

2. Our Role in Processing Personal Data

Applicable data protection laws may distinguish between organizations that process personal data for their own purposes (known as “controllers”) and organizations that process personal data on behalf of other organizations (known as “processors”). When we collect and use personal data as described in this Privacy Notice, we act as a controller. When our customers use our Services, we may process data as a processor on behalf of and in accordance with our customers’ instructions. If your data is processed through a customer’s use of our Services, please refer to that customer’s privacy notice for information about how your data is handled.

Lawful Processing: We process your Personal Information only to the extent necessary for the performance of our obligations to you in providing our Services, to comply with legal obligations, to protect our legitimate interests, or where you have given your consent. You may withdraw your consent at any time; however, doing so may affect your ability to use the Services.

3. Personal Data We Collect

Information You Provide Directly

  • Contact Information: Your name, email address, and communication preferences.
  • Professional Information: Job title, company name, and professional background.
  • Account Information: Login credentials, profile data, and files or content you store with our Services.
  • Payment Information: Payment details are processed by third-party payment providers. We do not directly store your credit card or payment account details.
  • Feedback and Support Information: Messages, chat content, and other communications you send to us.

Information Collected Automatically

  • Device and Network Information: Device type, operating system, IP address, browser type and version, and device identifiers.
  • Usage Information: How you interact with our Services, including pages visited, features used, time spent on pages, search queries, and browsing behavior.
  • Location Information: General location derived from your IP address.

Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect information about your interactions with our Services. A “cookie” is a small piece of data placed on your device that may include a unique identifier. We use both:

We do not sell any Personal Information of our users to third parties.

5. How We Disclose Your Personal Data

  • Service Providers: Third parties that help us operate, maintain, and improve our Services (e.g., cloud hosting, analytics, customer support). These providers do not have the right to use your Personal Information beyond what is necessary to assist us.

We do not sell your personal data or share it with marketing providers or advertising partners.

6. Your Privacy Choices

Email Communications

You may unsubscribe from promotional emails by using the unsubscribe link in any promotional message. Please note that you may still receive transactional or service-related communications.

Cookies and Automatic Data Collection

You can modify your browser settings to refuse or delete cookies. You may also adjust your email provider or device settings to limit certain tracking technologies. Please note that disabling cookies may affect the functionality of our Services.

Device and Platform Preferences

You may adjust permissions on your device or connected platforms to control what data is shared with us.

Consent Withdrawal

Where we rely on your consent to process Personal Information, you have the right to withdraw that consent at any time by contacting us at help@agentfinch.com. Withdrawing consent may affect your ability to use certain features of the Services.

7. Access, Correction, and Deletion

You have the right to access the Personal Information we hold about you and to request a copy of that information. Upon receipt of your written request, we will provide you with your data, although in certain limited circumstances permitted by law, we may not be able to make all information available (for example, where it pertains to another user).

We will make every reasonable effort to keep your Personal Information accurate and up to date. You may request that we update, correct, or delete your Personal Information at any time by contacting us. We will endeavor to respond to all requests in a timely manner.

8. Security

The security of your Personal Information is important to us. We use commercially reasonable technical, contractual, administrative, and physical security measures designed to protect Personal Information against unauthorized access, alteration, disclosure, or destruction. We have implemented procedures to limit access to your data to designated staff who reasonably require it to fulfill the purposes communicated to you. However, no method of transmission over the Internet or electronic storage is completely secure, so we cannot guarantee absolute security.

9. International Data Transfers

Your personal data may be transferred to and processed in the United States and other countries where our service providers operate. These countries may have data protection laws that differ from the laws of your country. By using the Services and providing us with your data, you acknowledge and consent to such transfer. We take appropriate steps, including the use of Standard Contractual Clauses where applicable, to ensure that your personal data remains protected in accordance with this Privacy Notice and applicable law.

10. Data Retention

We retain Personal Information and Access Credentials for as long as necessary to fulfill the purposes for which they were collected, including to satisfy legal, accounting, or reporting requirements. We may retain certain data as necessary for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data or account recovery. When personal data is no longer needed, we securely delete or anonymize it. All retained data remains subject to this Privacy Notice.

11. Children’s Privacy

You must be at least 13 years old to use the Services. We do not intentionally collect Personal Information from children under the age of 13. If a child under 13 submits Personal Information to us and we become aware of it, we will attempt to delete that information as soon as possible. 12. European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, the following rights apply to you under the General Data Protection Regulation (GDPR) and equivalent local laws:

  • Right to Be Informed: You have the right to clear, transparent information about how we use your Personal Information. This Privacy Notice fulfills that obligation.
  • Right of Access: You have the right to obtain confirmation of whether we process your Personal Information and to request a copy of that data.
  • Right to Rectification: You have the right to request correction of inaccurate or incomplete Personal Information we hold about you.
  • Right to Erasure: Also known as the “right to be forgotten,” you have the right to request deletion of your Personal Information where it is no longer necessary for the purposes for which it was collected, or where you withdraw consent.
  • Right to Restrict Processing: You have the right to request that we limit the processing of your Personal Information in certain circumstances (e.g., while we verify its accuracy).
  • Right to Data Portability: You have the right to receive your Personal Information in a structured, commonly used, and machine-readable format and to transmit it to another controller.
  • Right to Withdraw Consent: Where we rely on consent as the legal basis for processing, you may withdraw your consent at any time by contacting us.
  • Right to Object: You have the right to object to certain types of processing, including processing based on legitimate interests.
  • Right to Lodge a Complaint: If your concern is not satisfactorily resolved by us, you have the right to lodge a complaint with your local data protection authority.

If you are a customer or end user of one of our customers, please contact that customer directly, as we may be acting as a data processor on their behalf.

13. California Privacy Rights (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with additional rights regarding your Personal Information:

  • Right to Know: You have the right to request details about the categories and specific pieces of Personal Information we have collected about you, the sources of collection, the purposes for collection, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request deletion of Personal Information we have collected from you, subject to certain exceptions.
  • Right to Opt-Out of Sale or Sharing: Agent Finch does not sell or share your Personal Information as defined by the CCPA.
  • Right to Non-Discrimination: You have the right not to be discriminated against for exercising any of your CCPA rights.

To submit a request, please contact us at help@agentfinch.com. We will verify your request using information associated with your account, including your email address. You may also designate an authorized agent to exercise these rights on your behalf.

14. Third-Party Links and Services

Our Services may contain links to third-party websites or services. This Privacy Notice does not apply to those third-party sites or to the practices of any third parties that we do not own or control. You are responsible for reviewing the privacy notices of any third-party services you access in connection with our Services.

15. Changes to This Notice

We may update this Privacy Notice from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on our website prior to the change becoming effective. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Privacy Notice.
